1. AMENDMENTS TO THESE TERMS AND CONDITIONS

Marsh Loves Mallow reserve the right to change or amend these terms and conditions at any time, without notice.

It is the responsibility of you as the customer to read our T’s and C’s before continuing through the payment stage, as completing payment constitutes you agreeing to our terms and conditions.

2. DELIVERY

​

Delivery is made through a tracked courier of our choosing, and you will receive confirmation of postage via the email you gave us via your completed order. It is your responsibility to provide us the correct contact information including postal address, post code, and telephone numbers.

We dispatch orders Monday - Friday using DPD, Royal Mail & Hermes Services dependent on your chosen service and location. Delivery usually takes 2-3 working days (Some further afield locations like the Scottish Highlands may take longer due to local couriers work schedules)

There may be delays in orders due to adverse weather conditions throughout the year or COVID 19 – WE DO NOT TAKE ANY RESPONSIBILITY FOR DELAYS TO ANY ORDERS WITH OUR PRODUCTS BEING PERISHABLE.

We make all of our products fresh and there is a 7-10 working day turnaround from ordering to receiving your order, although we will try to get your order out quicker when possible. PLEASE NOTE: At high peak times like Easter, Christmas and summer wedding dates these postal timings can be longer.

Occasionally parcels can get lost in the post.  If you think this has happened please contact us immediately.  We reserve the right to cancel the order if we cannot fulfill the order for a second time.  We also reserve the right to cancel an order if we believe the user is falsely claiming an order has been lost.  Please see point 12. Regarding fraud.

3. RETURNS AND CANCELLATIONS

​

WE DO NOT OFFER CANCELLATIONS OF YOUR ORDER AFTER PAYMENT HAS BEEN MADE IN ANY CIRCUMSTANCES

In the unlikely event that you are not satisfied with our products, please contact us as soon as possible on hello@marshlovesmallow.co.uk

Please include the following in the e-mail;

  • your order number

  • the problem with the products

  • photos of the issue - We can not offer any solution without proof

If you are unsatisfied with your order, PLEASE DO NOT EAT IT, as we may request them to be returned to us for further inspection.

 

4. ALLERGENS

​

All of our products are made in a kitchen that handles all known allergens, including but not limited to eggs, milk, soya, sesame and nuts, peanuts, gluten etc. We take every care to clean equipment before use to avoid contamination, however this cannot be guaranteed. 5. PRICING AND PAYMENT

​

Orders will only be dispatched once paid for in full.

We reserve the right to cancel your order and refund the cost in full.

Payment will be collected through our chosen payment provider.  We reserve the right to change payment provider at any time without notice.

We reserve the right to change the price of any product(s) at any time, without prior notice.

6. PURCHASES

​

All purchases made through our website are non-transferable.

When an order has been processed, you will receive an order confirmation e-mail from us.  If you do not receive an order confirmation from us, please contact us at hello@marshlovesmallow.co.uk and we will check if your contact details are correct.

It is the responsibility of the user to check the order confirmation after placing the order.  If the user notifies us immediately of any errors in the order, we will do our best to amend the order, however we cannot guarantee the amendments will be made in time for the order to be processed.

For example, if the address or postcode provided by the user is incorrect and the parcel does not arrive, we acknowledge no responsibility for this.  No refunds would be given under this circumstance.  If the user requires another item to be sent, they are liable for the full price of the item and its delivery.  

 

7. THIRD PARTY LINKS AND CONTENT

We may link to external websites and content on our website.

We accept no responsibility for the content of third-party websites.

Any link on our website is clicked/followed at your own risk and on leaving this website the user will no longer be governed by these terms and conditions.

 

8. GENERAL

We use e-mail as our primary correspondence.  We will not be held responsible for any e-mails that you do not read because they went into your spam or junk mail folder.  Please check this folder on a regular basis, especially if you have recently made an order with us.

When creating an account or providing details during a purchase, please make sure these details are correct and up to date.

If we ever have reason to believe that an order has been placed fraudulently, or our website has been abused, we will share any relevant information with the police and third party fraud prevention companies.

  • Marketing and Communications Data may include customer preferences in receiving marketing communications from us and our third parties and customer communication preferences.

We may also process Aggregated Data from customer personal data but this data does not reveal customer identity and as such in itself is not personal data. An example of this is where we review customer Usage Data to work out the percentage of website users using a specific feature of our site. If we link the Aggregated Data with customer personal data so that an individual customer can be identified from it, then it is treated as personal data.

Sensitive Data
We do not collect any Sensitive Data about our customers. Sensitive data refers to data that includes details about race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about health and genetic and biometric data. We do not collect any information about criminal convictions and offences.

Where we are required to collect personal data by law, or under the terms of the contract between ourselves and our customers and the customer does not provide us with that data when requested, we may not be able to perform the contract (for example,  for the delivery of goods or services). Where this is the case, we may have to cancel a product or service but if we do, we will notify the customer.

  • Third parties or publicly available sources: We may receive personal data about you from various third parties and public sources as set out below:

  • Technical Data from the following parties: 

  • Analytics providers such as Google based & Facebook Pixel outside the EU;

  • Contact, Financial and Transaction Data from providers of technical, payment and delivery services from Stripe, USA.

  • Identity and Contact Data from publicly availably sources such as Companies House and the Electoral Register based inside the EU.

  • Our store is hosted on Wix who provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Wix’s storage mechanisms.



Payment:

All payments are processed via Stripe who stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

4. HOW WE USE YOUR PERSONAL DATA
We will only use your personal data when legally permitted. The most common uses of your personal data are:

  • Where we need to perform the contract between us.

  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

  • Where we need to comply with a legal or regulatory obligation.
